Sunpeak — Terms of Use

These Terms of Use ("Terms") govern your use of Sunpeak, a UV index & sun-safety app for iPhone. Please read them carefully.

1. Acceptance

By downloading, installing, or using Sunpeak, you agree to these Terms. If you do not agree, please do not use the app.

2. License to use the app

We grant you a personal, non-commercial, non-exclusive, non-transferable, revocable license to use Sunpeak on Apple devices that you own or control, in accordance with these Terms and Apple's usage rules. You may not copy, modify, reverse-engineer, resell, or redistribute the app except as permitted by law.

3. Subscriptions & purchases

Sunpeak offers an optional upgrade, Sunpeak Plus, which unlocks additional features. Sunpeak Plus is available in the following forms:

Weekly subscription — an auto-renewable subscription that includes a 3-day free trial.
Annual subscription — an auto-renewable subscription billed once per year.
Lifetime — a one-time purchase (not a subscription) that unlocks Sunpeak Plus permanently.

Important details about billing:

All billing is handled by Apple through the App Store and charged to your Apple ID.
Auto-renewable subscriptions (weekly and annual) renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours prior to the end of the current period.
You can manage or cancel your subscription at any time in your App Store account settings.
If a free trial is offered, any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
The price is always shown before you buy, and purchasing is entirely optional.

4. Your content & the information Sunpeak shows

Sunpeak shows UV index and forecast data and provides general sun-safety guidance (such as when to apply SPF and reapply reminders). This information is informational only and is not medical advice. You remain responsible for using your own judgment and for consulting a qualified professional about skin, health, or medical concerns. Do not rely solely on Sunpeak for decisions that affect your health or safety.

5. Apple's Standard EULA

In addition to these Terms, your use and any purchases are also governed by Apple's Standard End User License Agreement (the Licensed Application EULA), available at:

6. Disclaimer of warranties

Sunpeak is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, or uninterrupted operation. UV index, weather, and forecast data may be inaccurate, incomplete, or delayed, and you must not rely on it solely for sun-safety or health decisions. We do not guarantee that the app or its data will be error-free. Always use your own judgment and consult a professional for health concerns.

7. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising out of or related to your use of Sunpeak or reliance on the UV/weather data it displays. Nothing in these Terms limits any liability that cannot be limited under applicable law, including your statutory consumer rights.

8. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of Sunpeak after changes take effect constitutes acceptance of the updated Terms.
